These Terms of Service (“Terms”) govern your access to and use of iConnect, including the web application, API, background worker, and optional Chrome extension (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
1. The Service
iConnect helps you connect Gmail accounts, create email campaigns, import recipients, send messages with scheduling and throttling, and optionally measure opens and clicks. The Service is provided as software that you or your organization typically host and operate; features depend on your deployment and configuration.
2. Eligibility and accounts
You must be able to form a binding contract to use the Service. Access is granted through accounts created or seeded by your Operator. You are responsible for safeguarding your credentials and for all activity under your account.
3. Gmail and Google
Connecting Gmail requires authorization through Google OAuth and use of the Gmail API. Your use of Google services is subject to Google’s terms and policies, including applicable API Services User Data Policy requirements. You must only request scopes and access you need, and you must not misuse Google user data.
4. Acceptable use
You agree not to:
- Send spam, unsolicited bulk email, or messages that violate applicable law
- Impersonate others or misrepresent the sender or purpose of messages
- Harass, threaten, or distribute illegal, harmful, or deceptive content
- Violate anti-spam laws (such as CAN-SPAM, CASL, or GDPR/ePrivacy where applicable)
- Harvest or use recipient lists without proper consent
- Interfere with the Service, bypass rate limits, or attempt unauthorized access
- Use the Service in a way that harms Gmail, Google, or third parties
You are solely responsible for the content of emails you send and for compliance with laws governing commercial and marketing email in your jurisdiction.
5. Recipient data
You represent that you have the rights to import and process recipient information you upload to iConnect. You will honor unsubscribe and data subject requests as required by law and provide accurate sender identification in your messages.
6. Tracking
If you enable open or click tracking, you are responsible for disclosing tracking practices where required and for configuring TRACKING_BASE_URL (or equivalent) so pixels and links function lawfully and reliably.
7. Chrome extension
The optional extension interacts with Gmail and your iConnect API. You use it at your own risk and must comply with Chrome Web Store policies and Google’s terms when applicable. API tokens you create grant access to your account—keep them confidential.
8. Operator and self-hosted deployments
If your organization operates iConnect, that organization (“Operator”) controls availability, security, backups, and support. These Terms apply between you and the Operator; open-source or third-party licenses may also apply to the software itself.
9. Availability and changes
The Service may be modified, suspended, or discontinued without notice, especially on self-hosted installations. We may update these Terms; material changes will be reflected in the “Last updated” date. Continued use after changes means you accept the revised Terms.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SENDING WILL SUCCEED, THAT TRACKING WILL BE ACCURATE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER ICONNECT NOR YOUR OPERATOR WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU PAID NOTHING.
12. Indemnification
You will indemnify and hold harmless the Operator and those involved in providing the Service from claims arising out of your content, your campaigns, your violation of these Terms, or your violation of third-party rights or law.
13. Termination
Your Operator may suspend or terminate your access at any time. You may stop using the Service by discontinuing access. Provisions that by nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.
14. Governing law
These Terms are governed by the laws designated by your Operator, without regard to conflict-of-law rules. If no designation is made, the laws of the jurisdiction where the Operator is established apply. Disputes will be resolved in the courts of that jurisdiction, unless mandatory consumer protections require otherwise.
